I got pregnant at 15 while I was in Mexico my boyfriend was 20. Now I’m 16 and he’s 21, can my boyfriend still get in trouble by the law even if I conceived in Mexico? I was born in Mexico the laws are way different over there. I came to the U.S. to have my baby I am a green card hold my bf is coming and wants to be with me during the delivery. My parents have agreed to us getting married soon after our baby is born, my parents know him and they know he will care for the baby and me he’s no harm. Can I tell the hospital to not report him because he’s no harm to neither of us? Or will the hospital still report if nothing was forced (it was all voluntary) and parents agreed to it?
Answer
In the State of Texas, it is illegal for a 16 year old to have any sexual contact with a 21 year old. For any prosecution to occur in Texas, however, the contact must have occurred in Texas. The fact you conceived a child in Mexico is NOT a violation of Texas Law. If the two of you return to Texas and continue to have sexual contact, your boyfriend will be subject to criminal prosecution.
