Asked 8/1/2016 – Amarillo, TX

Someone went to prison on their 3 rd Dwi. Their lawyer appeals their sentence and ask for a reconsideration of the time to serve. then they were put in solitary confinement . Is this normal? how long till the judge acknowledges it and if they get a new trail and what happens after that

Answer

It is questionable whether anyone at the prison facility even knows about what motion have or have not been filed with the court by an inmate’s attorney, so no, placement in solitary confinement is not the result of filing a motion for reconsideration of time. Placement in solitary confinement is usually done for either for his protection or for punishment for his behavior.
