I’m being accused of false substance abuse around my daughter and cps is involved and they want me to take a drug test. Do hey have the legal right to make me do this and not let me see my daughter without court order????
Answer
Yes and no. You can refuse to cooperate with CPS. If that is what you choose to do, buckle up and get ready for a bumpy ride. A case will be filed with a court if competent jurisdiction, an order for drug testing will be entered and court ordered supervision will begin. You will spend the next year or so your life minimum and thousands of dollars in attorney’s fees trying to get CPS out of your life. Or you can take the drug test, prove the drug charges are baseless and politely ask them to now, go away. Talk with a local attorney to go over where this matter stands with CPS.
