Asked 3/17/2016 – Weatherford, TX

I was charged with Possession of a controlled substance. The officer found a pill in my pants pocket (hydrocodone) and I had a Prescription for the medication. I told him where to find the prescription bottle and he was unable to locate it (in my car). I had no problem finding it after I got released from jail and got back to my car. Rather than being found innocent (as I should have been) the DA just dismissed the charge. So this continues to show up on the local Sheriff’s Office Website and I have been told that due to this I would no longer be considered for a job (On 7 occasions now) as their (the sheriff’s office website is searchable for this county) and every on assumes it was a plea along with the other charge of driving with an invalid license. That is not the case. I have the prescription info, the bottle and my attorney also had the info. Is there anyway to get this removed from their website.

Answer

You should contact a local attorney about filing a petition for expunction. This will order the removal of all records of the incident.
