Asked 3/21/2016 – Waco, TX

My boyfriend was arrested in July 2015 for reckless driving because he crossed over the line to miss a cat. They asked to search my car which he was driving and he deined them. The police still searched my car without premission. He also rolls his own cigarettes and was charged with paraphernalia because he had rolling paper. He was bonded out the next day. A court day has never been set.

Answer

There is a 2 year statute of limitations from the date of the alleged offense on misdemeanor cases in Texas. The State must file the charging instrument with the court within that time frame.
