My friend got a DUI ticket a few months back, he hasn’t settled in court yet and will be meeting again in two months. They said his license was suspended. And now today he got into a car accident that was his fault by rear ending someone. He lives in TX

A DUI is a class c offense in Texas, punishable by fine only (as opposed to a DWI) so he won’t go to jail over that charge. Repeated Driving While License Invalid/Suspended, however, is a more serious offense which can have a jail sentence imposed as punishment. Your friend knew about the suspension, yet continued to drive. To claim. “Gee, I have to drive, even though my license is suspended.” is telling the court, “Judge, I am going to continue to break the law and have no desire to fix my situation.” Those types of people go to jail. Get a local attorney, find out why the license is suspended and clean this mess up before it gets worse.
