Asked 3/22/2016 – San Marcos, TX
On march 26 2015 I was arrested for probation violation and received a ticket for expired inspection sticker in san marcos tx. I have been released from probation since the incident. I recently found out that I have a warrant for not going to court for driving while license suspended and I was never arrested for that. I requested for an open records request for the bond information and the signature on the bond is forged and looks nothing like my signature. They county clerks are saying the only way for the warrant to be removed and receive a new court date is turn myself in to jail and pay a new bond to get out. Which is unfair and I feel unjust seeing that I am being punished for a crime I have not committed. Why would i go to court for one issue and not show up to court for another if I was arrested for both on the same day? Please help.
Answer
I understand your feelings about your situation, but a warrant is outstanding for your arrest, whether you feel it is just or unjust. The question I have deals with the notice you received of the charges pending against you and subsequent notice of the court date. A warrant can only be removed by your arrest, posting of a bond or by recall by a Judge. Get a local lawyer. He/She can examine the file, and if there is some problem, the Judge in you case may be convinced to recall the warrant and set a new court date.
