Asked 3/29/2016 – Waco, TX
Back in 2012 I have received a Class B Misdemeanor in Texas (Theft >=$50 <$500) and was sentenced to 1 year deferred adjudication. I have successfully completed the requirements that the judge and after going through several job interviews and not being able to renew my Concealed Handgun License I have decided to file for a petition for nondisclosure and an affidavit for indigency. I have an appearance in front of a judge for this next month but I have no clue what to present to the judge.
Answer
You have 2 issues. 1) the affidavit of indigence to waives any filing fees associated with the filing of your petition for non-disclosure and 2) the actual petition for non-disclosure itself. On the inability to pay issue, bring proof of your bills and proof of your income (tax return, bank statements, etc). On your petition, I’m not sure how much help the Judge can give you on what it should contain. The clerk MAY have blank forms that you can complete, but you are probably on your own to research the contents of a petition for non-disclosure.
