Asked 4/5/2016 – Austin, TX
I’ve been arrested for stalking in TX. Case returned NO-BILL. A misunderstanding and police misconduct was the sole cause for bringing the charge. My alleged (victim) and her family stood aggressively with me. They gone crazy when they learned about my arrest. They dissolved the protective order and paid for the attorney expenses. Statue of Limitation has not passed.
Answer
The District Attorney CAN agree to an expungment prior to the statute of limitations, but you only get one bite at the apple on these cases. If your early petition is denied, you cannot file again. Have your attorney contact the DA BEFORE YOU FILE THE PETITION and see if any objection will be made.
