Asked 4/9/2016 – Houston, TX

I was a co signer on a bond. The defendant did miss the first court date but did call and reschedule that same day. It has been 3 years, can they sue me even though the bond was never forfeited and he attended every single court hearing after that day until the case was over. They are trying to sue me for $1500 and I think it is ridiculous because the bond was never forfeited. please help

Answer

Contact the defendant’s attorney and make sure the bond was never forfeited. You state the defendant did miss a court date and it is possible the bond was forfeited but the Court allowed a subsequent PR bond to recall the warrant. There is no reason for a bond company to sue you if they are not called on to pay the bond. If you can’t contact the defendant’s attorney, you might have to retain one on your own.
