Asked 4/9/2016 – Fort Worth, TX

Ok this is going to be kinda long so I hope it’s not too confusing. My girls and I lived with a disabled man and pay rent. I heard from my youngest daughter, who is 4 that he turned on movies that people were naked and fighting each other when I would leave to run errands. She has a wild imagination so I wanted to confirm with my older girls ages 9 and 11 if what she said was true but before I had the chance to talk to them (They were gone for the weekend) he told me I needed to move ( I think he thought I knew what had happened) Before I could move he actually called 911 to have them remove me from his home but he was told unless I committed a violent act there was nothing they could do until I was officially evicted. Then he called back to 911 and told them I pushed him down in his wheel chair. So they came to the house and I got arrested for battery of a disabled person. He had no marks on him (probably because it was a total lie. Well there is a protective order against me so I can’t get any of our stuff (everything we own) he was told he could get rid of our stuff for 30 days but has thrown most of our stuff but kept anything worth money.

Answer

You are going to have to hire local attorney. There should be a recording of the 1st 911 call, informing him that you could not be evicted unless a violent crime had been committed. If a 2nd 911 call comes in shortly thereafter, it will be strangely coincidental. Get an attorney soon to get the 911 recordings.
