Asked 4/9/2016 – Dallas, TX

Can a polygraph be submitted to the prosecutor after a criminal indictment in consideration of dropping the charge? Also, can my criminal defense attorney submit the polygraph into evidence if the case goes to trial?

Answer

Your attorney can submit polygraph results to the District Attorney in your case; what the DA decides to do with it is anybody’s guess. Polygraph results are NOT admissible as evidence at trial.
