Asked 4/11/2016 – Abilene, TX

borrowed another persons car and got stopped at which time there were drugs found in the glove box . There was another person in the car at the time . I was charged with a 3rd degree felony .

Answer

A third degree felony is punishable by a jail sentence from 2 to 10 years in the Texas Department of Corrections, a fine of up to $10,000 or a maximum probationary period of up to 10 years. It appears you are eligible for probation. The State has the option of dismissing the charges, but as a general rule, cases are dismissed because the DA doesn’t believe there is enough evidence to win at trial, not because it is someone’s 1st offense. Talk with a local attorney soon.
