Asked 4/14/2016 – Carrollton, TX

I do not have a drivers license and got caught speeding (86 mph on a 60 mph zone). The officer, however, only gave me a citation for the speeding, not for driving without a license. I was told I could get the citation off of my record if I took defensive driving, but I’m sure I can’t take that without a license.

Answer

You are correct; you are not eligible to take defensive driving to dispose of a traffic citation if you do not have a valid Texas driver’s license. You may be able to avoid a conviction on this citation through deferred disposition, depending on the city where your ticket is pending. Contact a local attorney for assistance.
