Asked 4/15/2016 – Kyle, TX

I have Cps investigating a report filed by police for domestic violence.

Answer

I could give more information if you request, but the bottom line is: yes. Child Protective Services can interview a minor child without notice to the parent and without the parent being present. Prior notice or the parent’s presence could, in the State’s opinion, potentially cause improper influence on the child’s statement. If you are being investigated by CPS, contact a local attorney as soon as you can.
