If I test positive for alcohol on a drug test do they just waive it?

I am on pre trial diversion probation. I have no restriction on alcohol consumption in my papers.

Answer

You can ask your attorney or the pre-trial diversion coordinator, but if you are over 21 and there is no restriction on your consumption of alcohol in your diversion agreement, you have not violated any terms. Doesn’t mean the terms won’t be modified, however. Talk with your attorney soon.
