How long do they have to indict her once she bonds out before the case gets dropped?

My sister in law had custody of her granddaughter and then cps took her away and gave her to the child’s grandparents on the other side. Then my sister in law took her back and got a kidnapping charge.

Answer

The State has a 5 year statute of limitations window to file the charging instrument on a kidnapping case (See Texas Code Of Criminal Procedure Article 12.01 (4)(B)). Contact a local attorney as soon as you can to see if anything can be prepared before indictment to prevent the filing of the charges.
