My husband is locked up since Thursday April 14th, he was on probation last year for a burglary of habitation and theft back in 2012 he stopped going to see his probation officer because we we’re pregnant with our second baby and I needed him with me all the time and helping me with our back then 1 year old son, he would do side jobs to help out with bills until we moved in with my mom due to me losing my Job because of that we didn’t have money for the bus either, he had a speeding ticket and about 5 others warrants/ tickets but nothing major and those ones are already time served expect for the property theft and burglary of habitation, he never once caught charges either, he’s stayed out of trouble…..he needs a different probation officer on that will actually answer his phone and what not be professional and yet look ay me
Answer
Burglary of a habitation is a second degree felony, punishable by confinement in the penitentiary for up to 20 years. Not reporting is a HUGE problem in probation revocation cases. If a probationer quits reporting, why would a Judge reinstate a probation? The question for the court is whether the probationer will comply with the terms of probation, and the person has shown that if things get tough, reporting is the first thing to go. Talk with his attorney soon.
