My bf was paroled out of Tarrant County. But he had a 20 month sentence in Johnson County. Now Tarrant released him by mistake and Johnson County wants him to serve the rest of the 20 year state jail sentence. Johnson County wants him to turn himself in. There is no warrant yet but will be. If this was a mistake on Johnson County’s part, what can we do to either keep him out of jail or get a reduced sentence? He is following his parole perfectly.

Answer

If your boyfriend has already been sentenced, that issue has already been resolved. If he had an attorney while he was in Tarrant County, have that attorney find out if Johnson County placed a hold on him; this is necessary to determine if credit can be given toward the Johnson County case for the time he spent in Tarrant. Until a warrant is issued for his arrest, he is not violating any law by not turning himself in, but it is only a matter of time. He may get some brownie points with the Judge in Johnson County if he shows up in court and tells the Court he will do whatever he is instructed to do. Talk with the attorney he had in Johnson County as well.
