I live in Texas, my fiancée and I want to get married before I turn myself in on a motion to revoke my felony probation. There’s a strong likelihood that I’ll be away for a while, so it’s important to us that we get to do this beforehand.

Anything is possible, but no background check is performed by a clerk when an application for a marriage license is filed. That being said, if a warrant is outstanding for your arrest, you are subject to arrest and detention if you are stopped for a traffic citation, driving to the court house, leaving the courthouse, going on your honeymoon, etc. You may want to talk with a local attorney before you take this life-long commitment of marriage.
