Asked 4/23/2016 – Dallas, TX

I was sexually assaulted by a nurse in a Dallas hospital in 2011. Can anyone give me the exact amount of years for the statute of limitations on sexual assault on Texas? I keep getting different answers. Thanks.

Answer

There is no statute of limitations on sexual assault If during the investigation of the offense, biological matter is collected and subjected to forensic DNA testing and the testing results show that the natter does not match the victim or any other person whose identity is readily ascertained or probably cause exists to believe that the defendant has committed the same or a similar sexual offense against five or more persons (Texas Code of Criminal Procedure Article 12.01 (1) (C)).

There is a ten year statute of limitations on sexual assault except as describe above (Texas Code of Criminal Procedure Article 12.01 (2) (E)).
