I got a speeding ticket and I went to the court and the clerk told me that since my name is not on the insurance I do not qualify for defensive driving. I am 19 and my car is in my dads name, the car is covered with liability insurance.

Answer

You must present 1) a valid Texas Driver’s license and 2) evidence of financial responsibility (insurance – see Texas Code of Criminal Procedure Article 45.0511 (b)(6). You must be a listed driver on an auto insurance policy in order to qualify for the mandatory defensive driving class, regardless if the car was covered by some other insurance.
