My daughter caught a 3rd degree felony drug charge while on parole. I’m curious what amount of time she could be looking at and what all could happen to her.

Answer

A `3rd degree felony is punishable by a fine of up to $10,000, incarceration from 2 to 10 years, or a maximum probationary period for up to 10 years., If she is on parole, that parole can be revoked and she could return to prison to serve the balance of the sentence assessed in her previous case. The parole revocation can happen before the new case is finalized; the new case does not have to be resolved before she is returned to prison. If she is in jail on a blue warrant (parole revocation warrant), no bond will be allowed, so she will remain in jail and an attorney will be appointed to represent her on her new case. Get with that attorney about the specifics of your daughter’s situation. If your daughter is in jail but the parole hold has not been issued, do not bond her out on the new case. The other warrant is soon to follow, and she will be back in jail with you out of pocket for the bond on the new case. Good luck.
