Asked 5/12/2016 – Mexia, TX
I was originally charged with a state jail felony in 2013. I sat in county jail for 3 months waiting on court and then was given 5 years’ probation. My probation got revoked less than a year later and in 2015 when I turned myself in. I was sentenced to 11 months state jail in March of 2015 but my paperwork says that the beginning date of my sentence was January 1 2015. When asked on job applications is my felony 3 years old or 1 year old and is there anything I can do since the January 1 date is not correct
Answer
Final convictions are just that, final. You are not eligible for either an expunction or non-disclosure. The only way to remove these cases from your criminal record is by pardon from the Governor. With respect to your conviction date, the question is whether your original probation was deferred adjudication or straight probation. If your original probation was deferred, your conviction date was not until you were revoked. You can go to the court and obtain copies of your paperwork, or contact the attorney who represented you to clean up the date issue. Good lick.
