In 1996, I was wrongfully convicted in Houston, Texas, of Burglary of a building. The jury sentenced me to 18 years. After serving 6 years, i was released on parole in 2002. I was free for 5 years then my parole was revoked & I served about 2 years. TDCJ acted like the 5 years that I was free on parole did not exist & they added it to the end of my sentence, turning my 18 year sentence into 23 years, 5 years beyond the jury’s proscription. Has this practice of revoking street time been challenged in Federal court?
Answer
A person does not have a right to parole, so pretty much whatever the parole board wants to do, they do. It is not prohibited that your street time be added to the end your sentence for parole purposes after a parole revocation.
