I was in my attorney’s office and he called DA to find out more info on my case. He was questioning the level of offense so as to prepare me for what I could expect in court . The DA unaware he was on speakerphone stated: this is what you can sell to your client because your such a good defense attorney etc. etc. we’re going to offer her mis probation. She’s going to be able to keep her job but she’ll have to testify against the codefendant unless the codefendant decides to go south on us which I don’t think he will. My attorney told me this was a first for him as far as mis probation was concerned and he was going to have to study up on it

Answer

The scenario you describe is a little confusing, but I assume you are currently charged with a felony and there is a co-defendant in your case; it appears the District Attorney will reduce the charges against you to a misdemeanor if you agree to testify against the co-defendant at that person’s trial.
