Asked 5/14/2016 – San Antonio, TX

If you only had 5 months left on parole, got a new charge are now incarcerated in county jail with parole violation no bond but have a bond for new charge, can you get released and if so will parole discharge you or reinstate your parole?

Answer

Your son will not be released until his parole revocation hearing is held. I do not know the facts of your son’s case, but getting arrested on a new criminal charge while on parole is usually an automatic return to prison. He will need an attorney to represent him on the new charge. Virtually, his only chance of being reinstated on parole is to have the new case dismissed.
