Asked 5/18/2016 – Houston, TX

If someone is currently serving Tdcj time and have pending case that’s closed with bench warrants can they make parole.
Any help or directions on low cost attorney to get the case to run cc would be great.

Answer

I am confused about the statement a “pending case that’s closed”. Is there a second case? Is there one case on appeal? If a case is closed, why are there bench warrants and who are the warrants for? If there is a pending case against a TDC inmate, a judgment of guilty must be entered on that case before any sentence could run concurrently. If the bench warrant is outstanding for the defendant on the second case, any TDC time currently being served will be credited toward back time. The defendant will NOT be granted parole if another case remains pending
