I am on probation for a dwi and I only have like 4 months left on a year’s worth of it and I got arrested for a public intoxication I don’t know what to do it’s my first violation the dwi is the only thing I’ve ever been in trouble before I need to know what’s going to happen.

Answer

Part of the probation agreement you made was for you to not commit any new offenses. You have violated this agreement. The State has the option to file a motion to revoke your probation, have a warrant issue for your arrest, and have the judge decide whether the terms of the probation have been violated. If the allegations of the motion to revoke are found to be true, you can be sentenced to jail or the Judge can continue you on probation, extend your probation and/or modify the condition of probation. What will happen in your particular case depends greatly n the input of the probation department. Contact your attorney soon.
