Answer

DWI with 2 previous convictions is a 3rd degree felony, punishable by up to a $10,000 fine, 2 to 10 years incarceration in the Texas Department of Corrections, or a maximum probationary period of up to 10 years. It is doubtful your bond will be raised upon receiving your blood test results, since the results won’t charge the charges against you. If your test results are under .08, a DWI could still be filed against you. For example, if there are any other intoxicants in your system along with the alcohol, such as the prescription medication you reference, the DA may choose to file the case. Talk with a local attorney.
