Asked 5/20/2016 – Houston, TX

my husband is in county was for simple parole violation for a technicality in Nov. he discharged parole completely in Feb during this time they have said he has a pending murder investigation. he’s still being held in county. He has no charges nor has he been indicted on any charges.

Answer

If the parole revocation was filed in November, 2015 and your husband was arrested prior to the discharge of his parole, his February 2016 discharge date no longer applies, so he is NOT discharged completely from parole. Parole can hold him without bond, and I will assume parole is waiting on the filing of the new charges before proceeding with the revocation. I suggest you contact a local attorney to discover the delay in the filing of the new charges.
