Asked 6/13/2016 – Channelview, TX

My Boyfriend is being charged with illegal reentry and is facing 0-20 years. When he was 17 he caught a felony and was given 10 years in a California prison. After he was release he was deported for the first time. He came back about 4 years ago. We have 4 kids smallest one just turned 4 months. It’s very, very difficult and stressful being a single mother. He is a wonderful, loving, caring father and a husband. I truly feel he does not belong in the Joe Corley Facility in Conroe, Texas. He belongs home with us, his family. I am praying that there is a way we can get these charges dismissed. The public defender that was assigned to he’s case says he has a better chance if we wait to go to trial after November. Not quite sure why but that was his advice. My mother in Law and myself are looking for a second opinion. We are looking for the right attorney who has experience with these kinds of cases. Someone who can help us. Please any advice would be GREATLY appreciated. Thank you for your time.

Answer

Talk with a local immigration attorney as soon as you can. I don’t want to give you false hope; you and your boyfriend have an uphill battle. You need to find a “hook”, someway that he could possibly remain in this country if the proper documentation was filed. I am not sure of your legal status nor that of your mother-in-law, but the fact that the father of your babies is in jail puts stress on your family is not a legal defense.
