Asked 6/13/2016 – Athens, TX

I struck a deal with the prosecutor to defer the speeding ticket along with a dollar amount and a 90 day probation. I checked the box to defer the ticket and signed as instructed. When receiving the paperwork in the mail, there was $50 additional dollars added to the agreed amount. Saying, If I paid the full amount right away, the ticket would be deferred. Also to have a copy of my driving record within 10 of the 90 day probation expiration. I don’t understand. I already agreed to a different amount.

Answer

A Judge has the power to deny any plea bargain offer submitted by the parties: if the plea is rejected, however, the defendant has the right to withdraw any plea of guilty or no contest, enter a plea of not guilty and set the case for trial. I do not know the procedures of the court in question, so this may just be a typographical error. Call the court, see when the next court docket is being held, then appear in court while the prosecutor is present and find out what happened.
