This person violated parole for a family violence incident. The court set a motion to revoke and he failed to show up to that hearing, now there is a motion to adjudicate guilt. The county website says that it has been reset 3 times and this last time there was a bailiff certificate placed in the notes. I just want to understand what this means.
Answer
Was this person on parole or probation; motions to adjudicate guilt are filed in cases where a defendant was placed on deferred adjudication probation, and subsequently an allegation the probation was violated is filed, i.e., the motion to adjudicate. The bailiff’s certificate is documentation that the defendant did not appear in court as directed, the bailiff called the name of the defendant at the doors of the courtroom and received no response. The Court then has the authority to forfeit any bond posted in the case and issue a warrant for the arrest for the defendant
