I am Tenant, my Son not. He was rude to maintenance man and now complex saying they are getting a No Trespass Order to keep him from the property. How long until he can’t come over any more? How do they have to give notice?

Can they do this?

Answer

It’s not a “no-trespassing order” that will be obtained, but a criminal trespass warning. The common grounds of an apartment complex is a public place, so anyone has access to it. However, the owner of the property has the right prohibit access to certain individuals. If that individual is given a criminal trespass warning (usually in writing and signed by the individual), the individual can be arrested if he or she appears on the property.
