Def Adj for STF, 25k Restitution. 18k paid. Texas Criminal Code says that only 1-3 Felonies can be extended to 10 yrs SJF is 5? At 5 yrs if I still owe but haven’t been willfully refusing to pay – what can the outcome be. And do I need an attorney for this?

Answer

If restitution was a condition of probation, failure to pay restitution can result in a motion to adjudicate being filed, a warrant for your arrest to be issued, and if the allegations in the motions are found to be true, you could be sentenced to confinement in a state jail facility for up to 2 years. Yes, you need an attorney for this.
