My husband was picked up on a federal drug conspiracy complaint a few months ago, and the only evidence they have is based on completely fabricated info, given by other co-defendants and convicted felons with prior drug charge, that were promised a lesser sentence in exchange for this info and or testimony. There is no physical evidence on him at all according to his discovery pack and the original complaint. My husband has never been to prison, nor has he ever even been arrested for drugs. Is their testimony alone, enough to get a conviction against my husband?
Answer
You really should talk with your husband’s attorney. I understand the stress of the situation you are going through, but your question presupposes the answer. Do you really thing the co-defendants in your husband’s case are going to take the stand and testify: “We are lying. We are only saying this in exchange for a lesser sentence. What the defendant is saying is totally true”. NO! There will be several witnesses, albeit co-defendants, who will take the stand and clam you husband is Walter White come to fruition, that HE is the mastermind who started all this and if it wasn’t for HIM, none of this would have happened. Who is telling the truth? That is for Judges and Juries to decide. Go to trial and take your chances or accept the plea. Be as informed as you can, make a decision and live with the consequences.
