Asked 6/25/2016 – Wheeler, TX

My wife got a possession charge in TX in Jan and we live in AR. She called the number and had some options and she picked probation. It’s now almost July and the officer hasn’t even filed the report and we haven’t heard anything about the probation. Is there a statue of limitations on this to where we can just get everything dropped?

Misdemeanor cases in Texas have a 2 year statute of limitations; felonies have a longer time, and vary depending on the offense. I do know you can’t “pick probation” over the phone for a drug charge and I would not want a warrant to issue for your wife’s arrest because you are calling the wrong place. Call an attorney in the county where she was arrested, and see if the status of her case can be discovered.
