My husband had a 3 year old possession charge out of Collin County, he’s been on bond since then and had a pre-trial hearing in early June. We just had a baby and accidentally missed the date. When he showed at his next hearing, he was detained – no bond. I decided to pay an attorney and paid him $1500 three weeks ago – he assured me my husband would be out in the next few days. Today, three weeks later, I haven’t been able to get in touch with him – minus his office calling for the 2nd payment. I was assured as soon as I paid, my husband would be out. Before doing so I called the court and he doesn’t even have another bond hearing until late July. Is this right? I’d really like my money back, that was all our reserves and I put it up to ensure my husband wouldn’t lose his job. It’s been over three weeks and if this goes another month, my husband will not have a job and we will have no reserves. We have a newborn baby to care for and I don’t know what to do.

Whether you will get a refund from your attorney is between you and him. If you made an agreement, you both have to live with it. You need to have a face to face meeting. You honestly believe he promised you your husband would be out in a few days. You will probably be told that the attorney said he would see what he could do about getting your husband released in a few days, but no promises were made. Better communication must be established if you are going to trust this guy, so schedule an appointment IMMEDIATELY. If the trust issue is past the point of no return, contact another attorney.
