My former partner is a sex offender, this happened back in 2007. At that time he was 16 and she was 13, but she lied about her age. He just got out 2 years ago; there are people that know that he didn’t sexually abuse her. She was also sleeping around with his friends and his older brother. Is there anything he can do to take this off his record?

Answer

No, this conviction cannot be removed from your friend’s criminal record (except by pardon from the Governor). The fact that 1) she lied about her age, and 2) was sleeping around has no bearing on the matter. Having sex with a 13 year old as you describe is sexual assault, even if she consents. You friend MAY, at some point, be able to remove the sex offender registration requirements imposed upon him by the conviction.
