Asked 7/12/2016 – Denton, TX

I was issued a ticket for parking in a handicap spot on a QT store parking lot. I didn’t know it was a handicap spot. The sign was posted on the ground so I didn’t see it until I went back to take pictures and I saw it posted on the ground and then I saw one posted in the window of the parking lot. I want to fight the ticket but I’m not sure if I can win since it was posted and I just didn’t see the signs. I am an American with a disability which includes hearing and learning so in part I function at a lower level than my age group for understanding how things work in this world I’m 22 years old.

Answer

You can contest any matter you deem fit. The fact you did not see the handicapped parking sign is not a defense nor is the fact the parking space is on personal property. If your disability qualifies you for a handicap parking placard, you may present it to the court, but a learning or hearing disability will generally not entitle you to such parking.
