Asked 7/22/2016 – Corpus Christi, TX

I was charged with assault/attempted murder several years ago. Then my attorney said that charge was a sort of catch all but after I took a plea. I plead to lesser included class a assault, completed all conditions and probation and nothing further is on my record.

Answer

If you were given straight probation and found guilty, or if there was an affirmative finding of family violence, you can never have the case expunged or non-disclosed. If you were given deferred adjudication probation and the case was dismissed, you MAY be able to petition the court for an order of non-disclosure.
