Asked 7/23/2016 – San Antonio, TX
Two and a half years ago I was arrested for DWI. An intoxilock was placed in my truck and I never had any issue. Recently my DWI case was over and dropped in return for pleading guilty to obstruction of highway and receiving deferred adjudication. I have a home device for six months. I drank at home last week and failed my am blow. Notified probation and the judge issued a warrant for my arrest with no bond. I am to turn myself in on Monday. What will happen I no longer have a lawyer to ask as I can’t afford one. This is my first issue. I have completed all of my required probation items. I also explained that I had a mania issue that night due to having bipolar disorder. What happens when I turn myself into the jail? I am in Veterans court and the judge is very tough. No one will explain to me what may happen. Please assist.
Answer
The State has filed a motion to adjudicate your probation, alleging you have violated one of the terms of your probation. Contact your attorney. You will have to either post bond to remove the warrant and get a court date, or turn yourself into jail and wait to be brought to court. If at court, the allegations are found to be true, the Judge can modify your probation, extend your probation, or revoke your probation and send you to jail for up tom 180 days.
