Asked 7/27/2016 – Sierra Blanca, TX

We were driving from New Mexico to Houston and got the ticket. We called several times and were told there was no record. Now 10 years later, a lawyer is saying I owe 700$, is there a statute of limitations on this in TX?

Answer

The statute of limitation on misdemeanor cases in Texas is 2 years, but the statute is tolled when the charging instrument is filed. Call an attorney in the county where the warrant is outstanding. I’m fairly confident the matter can be resolved for less than $700.
