Asked 7/27/2016 – San Antonio, TX

I got a parking ticket this morning at 9 am. I was parked in front of my house, and I was even halfway up in my driveway (had another car in it). My right tires were technically 14-15 inches from the curb, which from my understanding the law is 18. On the ticket, he failed to put my expiration date, didn’t put the color of my car, nor did the put the color or vin of my car. I have been doing a bit of research on this. Since he failed to fill in some important parts of the ticket, and my right tires were parked less than 18 inches from the curb, can I fight it? Thanks!

Answer

You can contest any allegation, but make sure you know the exact ordinance that you are charged with violating. The ticket is just a notice of when and where to appear. Upon entry of your plea of “not guilty”, the State will file a complaint which will state the exact ordinance you are accused of violating. Calling a local attorney couldn’t hurt.
