Asked 7/28/2016 – Arlington, TX

Cops keep coming to my apart looking for my ex. My address is not his listed residence. They have never shown me a warrant I have cooperated I haven’t talked to him in months and told them the state he fled to. They were nice the first time now they are hostile and keep telling me I’m going to jail if they see him here. All this in front of my kids. I get they have a job to do but I haven’t seen him and they told apart office he was living here and now I’m facing eviction for lease violation.

Answer

If police have a SEARCH warrant for your residence, you must let them in. If they have an ARREST warrant for your ex, they will look for him at any location they believe he will appear. Since he used to live where you are now, police will continue to look for him at your place. They may have crossed the line when they told apartment management he currently lives with you. Talk with a local attorney about your lease situation.
