I know someone who is a female adult who was 20 at the time of sexual consent with a male 16 year old who was due to turn 17 in two months but she was unaware of his age. Now 10 years later, his mom is claiming she was and adult and he was a child victim to use as a back up defense in their child custody agreement.

Answer

Any sexual contact between a 20 year old and a 16 year old is a criminal act. See Texas Penal Code 22.011 – Sexual Assault & Section 21.11 Indecency with a Child.
