Asked 8/1/2016 – Houston, TX
I have been on probation for 6 months. With my line of work it requires me to move around the United States. I can no longer hold on to probation for the reason of it holding me back from great opportunities. I signed this sentence with 1244A. Resulting in 3 years deferred probation. What kind of time am i looking at or what can i be facing? Any advice would greatly be appreciated.
Answer
Section 12.44 of the Texas Penal Code allows the prosecution of a state jail felony as a class a misdemeanor; the maximum probationary period for a class a misdemeanor is TWO years, so I’m a little confused about exactly what happened in your case. If you are convicted of a class a misdemeanor, the maximum, jail time is one year. If you are convicted of a state jail felony, the maximum jail time is 2 years in a state jail facility (day for day). Contact the attorney who represented you on your original plea
