Asked 8/1/2016 – Midland, TX

Charges were filed on my Childs father before he has been arrested. Does this mean a warrant will be issued or does the DA have to request a warrant after filing charges? I know a summons could be issued in place of a warrant but the charge is for injury to a child, is it likely that just a summons would be issued or a warrant? I want to know why charges were filed but he isn’t in jail yet

Answer

Yes, a warrant will be issued for your child’s father if charges have been filed and no arrest has ever been made. The reason why he is not in jail is probably because your case is not the only matter local law enforcement is dealing with at this time.
