Asked 8/2/2016 – Beaumont, TX

I had a tractor/trailer accident and spent slightly more than 100 days in county jail before being released on bail. I was convicted of 4 counts of criminally negligent homicide and was sentenced to 5 yrs supervised probation. Alcohol, drugs, reckless driving, sleeping at the wheel, etc. were not factors. Not having CB on and not keeping proper look out was, however. Probation was satisfactorily completed, so was discharged. I have had no other criminal activity before or since. Could I get my record expunged or sealed and get my privileges reinstated?

Answer

You can never obtain an expunction or non-disclosure on matter where a conviction has been entered. Final convictions are final. The only way to remove this matter from your criminal record is through pardon from the Governor.
